Nilesh Jain is a lawyer based in Delhi. He worked on Delhi Riot Relief efforts in 2020 on behalf of Lawyers for Detainees and Citizens Collective for Peace.[1] [2] At present, he is the counsel for Scihub and Alexandra Elbakyan in the Delhi High Court.[3] [4][5]
Involvement in Scihub case
[edit]Nilesh has a Master of Laws (LL.M.) from the University of Delhi. He had faced the issue of non-access to research material at the Central Library System of the University of Delhi, which inspired him to take the case of Sci-hub before the Delhi High Court.[6] He experienced lack of research resources first hand, therefore he was determined to help Alexandra with the copyright infringement lawsuit.[7] He has written about many issues, including Economics, Law and Elections in Telegraph India.[8] [9] [10][11][12][13]
Sci-hub Copyright Infringement case in India
[edit]The World’s major academic research material publishers filed a copyright infringement lawsuit against Ms. Alexandra Elbakyan. Elbakyan is the creator of Sci-Hub, a platform that provides free access to research publications and scientific material.[14] It promotes equality in access to scholarly and research publications for the benefit of the students and researchers, which consequently benefits the public. In December 2020, three big international publishers (Elsevier Ltd., Wiley LLC and American Chemical Society) filed a lawsuit against Ms. Alexandra/Sci-hub in the Delhi High Court.[15]
In the first hearing before the Delhi High Court on 24th December 2020, Nilesh Jain submitted in the court that "..given the stand taken by Mr. Sibal, Mr. Jain says no new articles or publications, in which the plaintiffs have copyright, will be uploaded or made available, by defendant no.1/Alexandra Elbakyan, via the internet, till the next date of hearing. The statement of Mr. Jain is taken on record."[16]
